The issues surrounding disability access and discrimination are varied and complex. A myriad of federal and state laws and regulations govern disability access and the employment of individuals with disabilities. We assist public and private entities and employers in complying with such laws, and defend litigation arising under those laws.
The Americans with Disabilities Act and other federal and state laws prohibit discrimination based on disability by employers, state and local governments, and private businesses open to the public. Such laws are extremely detailed and complex, and impose significant liability for even unintentional violations.
We defend property owners, business owners, public entities, and employers in claims and litigation involving property access, program access, discrimination, and denial of reasonable accommodations. We counsel employers on various issues, including determining what constitutes a "reasonable accommodation" and engaging in the "interactive process."
